1. Acceptance of Terms

By accessing or using MyMockup.io, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them. If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice within the Service. Your continued use after the effective date of any change constitutes acceptance.

2. Description of Service

MyMockup.io is an AI-powered mockup generation platform designed for Etsy sellers. The Service includes:

• AI-guided mockup image generation from product photos
• Reference-style matching using competitor or inspiration images
• Multi-image listing set generation
• The Prompt Lab for advanced prompt creation and refinement
• The Title Maker for Etsy listing title testing and optimisation
• Secure cloud storage of uploaded and generated images

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

3. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and current information during registration
• Keep your account credentials secure and not share them with others
• Notify us immediately at [email protected] if you suspect unauthorised access
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Subscriptions, Credits, and Billing

4.1 Plans and Credits

The Service is available on Free, Pro, and Pro Plus plans. Each plan includes a monthly credit allowance. Credits are used when you generate images — each image generated consumes one credit. Credits reset on your monthly billing renewal date.

4.2 Paid Subscriptions

Paid plans are billed monthly in advance. By subscribing, you authorise us to charge your payment method on a recurring basis. All fees are stated in US dollars and are non-refundable except where required by law or as stated in Section 4.5.

4.3 Credit Top-Ups

Pro and Pro Plus subscribers may purchase additional credit packs. Top-up credits stack with your monthly allowance and expire at the end of your current billing period. Unused top-up credits are not refunded.

4.4 Free Credits

Free plan credits are provided at our discretion and are subject to change. Free credits do not roll over between months.

4.5 Cancellation and Refunds

You may cancel your subscription at any time from your Account page. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not offer partial-month refunds for unused time. If you experience a billing error, contact us within 30 days at [email protected].

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Upload images that you do not have the right to use, or that infringe any third party's intellectual property rights
• Use the Service to generate content that is illegal, harmful, defamatory, obscene, or that violates any person's rights
• Attempt to bypass credit limits, reverse-engineer the Service, or access it by automated means beyond our intended API
• Use the Service to generate content that violates Etsy's policies or any applicable laws
• Share your account credentials or use the Service on behalf of multiple users under a single account
• Upload images of real people without their consent

We reserve the right to remove any content and suspend or terminate your account if we determine, in our sole discretion, that you have violated these provisions.

6. Intellectual Property

6.1 Your Content

You retain ownership of the product photos and reference images you upload. By uploading images, you grant us a limited licence to process them through our AI pipeline for the purpose of generating your mockups.

6.2 Generated Images

Images generated through the Service using your inputs are yours to use, including for commercial purposes such as Etsy listings. You are responsible for ensuring your inputs do not infringe third-party rights. We make no warranties regarding the intellectual property status of AI-generated outputs.

6.3 Our Platform

The MyMockup.io platform, including its software, design, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without our express written permission.

6.4 Training Data

We do not use your uploaded images or generated mockups to train AI models. See our Privacy Policy for details.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

The Service integrates with third-party providers for authentication, billing, AI generation, and support. Your use of those services is subject to their own terms. We are not responsible for the practices of third-party providers.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE AI-GENERATED OUTPUTS WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

AI-generated mockups are artistic interpretations. While we work to keep your product accurate in generated images, exact pixel-perfect reproduction is not guaranteed.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

11. Indemnification

You agree to indemnify and hold harmless MyMockup.io and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

12. Termination

We may suspend or terminate your account immediately and without prior notice if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your access to the Service ends. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will do so.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the courts of competent jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
